Terms and Conditions of Service for Jezcorp Ltd

Welcome to Jezcorp Ltd (“Jezcorp,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, and in-person services for the purchase and delivery of groceries, tobacco, and convenience items.

By accessing or using our services, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.  

1. Acceptance of Terms

By placing an order with Jezcorp, whether through our website, mobile application, or in-person, you affirm that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of England and Wales or other applicable jurisdiction. If you are under the legal age, you may not use our services to buy age restricted content.

2. Services Provided

Jezcorp Ltd specialises in the online and in-person sale and delivery of:

  • Groceries: A selection of fresh produce, pantry staples, dairy, frozen foods, and other household grocery items.
  • Tobacco Products and vapes: Various tobacco products and vapes, subject to strict age verification procedures as per UK law.
  • Convenience Items: A range of general convenience store goods.
  • Home Delivery: A convenient service for customers local to the registered business address. Or outsourced to delivery partnered for customers more further afield.

Our services include:

  • Online Ordering: Via our website for delivery both by delivery partners or ourselves.
  • In-Person Sales: If you see a representative while out and about.
  • Delivery Services: To specified delivery zones (refer to Section 6).

3. Account Registration

  • Account Creation: To place online orders, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security. Jezcorp cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.  
  • Age Restriction: You must be 18 years of age or older to create an account and place orders for any products, and strictly 18 years of age or older to purchase tobacco, vape and other age restricted products such as lighters or lighter gas.

4. Ordering and Payments

  • Product Availability: All products are subject to availability. While we endeavour to ensure accurate stock levels, occasionally items may be out of stock. In such cases, we will contact you to offer alternatives or a refund for the unavailable item.
  • Pricing: All prices are listed in GBP (£) and are inclusive of VAT where applicable. Prices are subject to change without notice, but changes will not affect orders already confirmed.  
  • Order Confirmation: Your order is an offer to buy from us. A contract is formed when we send you an email confirming your order.
  • Payment: We accept various payment methods as indicated on our website/app. All payments are processed securely by third-party payment processors. We do not store your full payment card details. By submitting an order, you confirm that the payment details provided are valid and correct.
  • Minimum Order Value: A minimum order value may apply for delivery services, as specified on our website, though normally this doesnt apply. There is a minimum order for free local delivery.

5. Age Restricted Products (Tobacco, etc.)

  • Legal Age: By purchasing tobacco products, you confirm that you are 18 years of age or older.
  • Age Verification: We operate a strict “Challenge 25” policy for all age-restricted products.
    • Online/Delivery: Our delivery drivers may require valid photographic ID (e.g., passport, driving license, or PASS card) upon delivery to verify the age of the recipient, If age cannot be verified, or if the recipient appears underage and cannot produce valid ID, the age-restricted items will be withheld, and a refund issued for those items only. The remaining non-restricted items of the order may still be delivered.
    • In-Person Sales: If buying in person, our staff will require valid photographic ID if you appear to be under 25 when purchasing age-restricted products. We operate a strict challenge 25 policy.
  • Refusal of Sale: We reserve the right to refuse the sale of age-restricted products to anyone we believe is under the legal age or is purchasing on behalf of someone who is.

6. Delivery and Collection

  • Delivery Zones: Delivery is available within specified geographic zones in the united kingdom. If you live within 5 miles of Diss, Norfolk, you will have the option of free local delivery as long as you have met the minimum order value. Please check our website or app to confirm if your address is within our delivery zone. Otherwise, your order will be sent with Royal Mail Tracked 48.
  • Delivery Times: We aim to deliver within the estimated timeframes provided at the time of order. However, these are estimates and actual delivery times may vary due to traffic, weather, or other unforeseen circumstances. Jezcorp Ltd will not be liable for any losses incurred due to delayed delivery. If you have opted for free local delivery, we will always contact you ahead of time if we anticipate a delay to your delivery.
  • Recipient Presence: For age restricted deliveries, a person must be present at the delivery address to accept the order. For age-restricted products, the recipient must be 18 years of age or older and able to provide valid ID upon request otherwise a standard postage service will be used. If our age verification partner has not been able to verify your age digitally, we reserve the right to use an IDS checking service from Royal Mail.
  • Failed Delivery: If a delivery cannot be completed due to the recipient not being present, inability to verify age, or inaccessible premises, the order may be returned to us. We reserve the right to charge a redelivery fee or a cancellation fee to cover our costs. In the case of personal deliveries, we will try to contact you upon failed delivery via phone but if no contact can be made, we will refund the original order amount to your card which will be with you in around 3-5 working days from issuance.
  • Collection: If you choose in-person collection, where available you must collect your order within the specified timeframe from our designated location. Age verification rules apply for restricted products.

7. Returns and Refunds

  • Perishable Goods: Due to the nature of perishable grocery items, we cannot accept returns for these products unless they are faulty, damaged, or not as described upon receipt. You must notify us immediately upon delivery of any issues.
  • Non-Perishable Goods: For non-perishable convenience items (excluding tobacco), returns are accepted within [Number] days of purchase, provided the item is unopened, unused, and in its original condition and packaging, with proof of purchase.
  • Tobacco Products and all vapes: Due to health and safety regulations, and the nature of the product, tobacco products cannot be returned or refunded unless they are faulty or not as described upon receipt. The same applies to vape products that have been opened and unsealed.
  • Faulty or Damaged Items: If you receive a faulty or damaged item, please contact us immediately with details and photographic evidence. We will arrange for a replacement, refund, or credit, at our discretion. We want to do what we can to keep you satisfied.
  • Refund Process: Refunds will be processed to the original payment method within 3-5 business days of approval. We will issue the refund within a day and the rest of the timeframe is due to bank processing times.

8. User Conduct

You agree not to use our services for any unlawful purpose or in any way that might harm Jezcorp, our customers, or third parties. This includes, but is not limited to:

  • Attempting to gain unauthorized access to our systems or other users’ accounts.
  • Interfering with the operation of our website or app.
  • Using our services to transmit unsolicited or unauthorized advertising or promotional materials.
  • Engaging in any activity that is fraudulent, misleading, or illegal.
  • Harassing, abusing, or threatening our staff or delivery drivers.

9. Intellectual Property

All content included on our website and mobile application, such as text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Jezcorp Ltd or its content suppliers and protected by UK and international copyright laws.

10. Disclaimer of Warranties

Our services are provided on an “as is” and “as available” basis. Jezcorp makes no representations or warranties of any kind, express or implied, as to the operation of our services or the information, content, materials, or products included on them. To the fullest extent permissible by applicable law, Jezcorp disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.  

11. Limitation of Liability

To the fullest extent permitted by law, Jezcorp Ltd, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising from:  

  • Your access to or use of or inability to access or use the services.
  • Any conduct or content of any third party on the services.
  • Any content obtained from the services.  
  • Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.  

12. Indemnification

You agree to indemnify, defend, and hold harmless Jezcorp Ltd, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable legal fees) relating to or arising out of your use of or inability to use the services, any user postings made by you, your violation of any terms of this agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Jezcorp reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Jezcorp in asserting any available defenses.  

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales.  

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.  

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Jezcorp Ltd regarding your use of our services.
